Dispute Over
Liquor License
for Homosassa
Restaurant
County Administrator Brad Thorpe
has notified the State Division of Alcoholic
Beverages and Tobacco (ABT) that its report
concluding that Citrus County gave zoning
approval for a liquor license regarding the
use of the Cedar Key Fish and Crab of Ho-
mosassa property as a bar and restaurant is
inaccurate. ABT officials stated that coun-
ty zoning officials confused the dates on
which two applications for a liquor license
were submitted to the county, and that one of
those applications includes a floor plan of a
bar and restaurant.
However, the floor plan showing a
land use as a bar and restaurant was never
submitted to the county for review. In fact,
the county obtained that floor plan from the
ABT itself, not from the owners of Cedar
Key Fish and Crab. Cedar Key Fish and
Crab has been embroiled in a long-running zoning dispute with the county over using the
site as a bar and restaurant in addition, or instead of, its vested use as a wholesale and retail
fish market.
The ABT came to its erroneous conclusion about the floor plans after reviewing its
file for the alcoholic beverage license it had issued to the business. County zoning officials
had placed the floor plan of the bar and restaurant into the county’s file after receiving it
from ABT, causing ABT to erroneously conclude that the floor plan had been submitted to
the county by the business owner.
It was only after the county was told the sketch sent to ABT was different from the
one it received that the county asked ABT for the sketch that agency received. As a result
of the differences, ABT did a follow-up review of the business’ beverage license.
Thorpe noted the county had made its zoning decision based on the only sketch it
had gotten, and that one did not include a seating area for serving food and drinks as did the
version submitted to the state. That land use is something the property was not zoned for,
Thorpe said.
