DEP ANNOUNCES TEMPORARY CLOSURES TO

While it is December and most people's attentions turn to the holidays, things slow down,

I would like to clear up some misinformation that was circulated last week in an anonymous
mailing called the No-See'um News. It stated "we have architectural standards that tell us
what materials we have to use to build a home, what color the house and the shutters can be".
This is not true. The architectural ordinance passed by this council, applies ONLY to commer-
cial structures and does NOT apply or address anything residential. Therefore you can paint
your house any color you wish. Also I would like to clarify another statement made. The
publication stated "we have tree ordinances that fine us $5000 for pruning our trees without
a permission slip". The requirement to have a "permission slip" for pruning was added in the
Emergencies section of the tree ordinance in February of 2007, and applies to tree permits
concerning trees that are claimed to be dead, diseased or weakened by age. It has been
thought that because the old ordinance required no permit for dead trees, some times a tree
would be cut down, or excessively pruned, when perhaps it wasn't dead. Excessive pruning
can kill a tree or cause irreversible damage. I think it was hoped that having someone knowl-
edgeable to look at the tree would help make a decision that might save a tree. Vice Mayor
Marsha Drew is now a licensed Arborist and has said she would be happy to help out in this
area. For any questions or if you are in doubt about the requirements of the tree ordinance
please contact our Zoning Officer, Chris Fineout. I would like to point out that Yankeetown
has had a tree ordinance for many many years. In the past, there seemed to be little penalty for
violating the tree ordinance therefore at times it was ignored. Increasing the penalty was an
