When Bernstein moved the metal object to his throat, the victim realized that it was a knife,
according to the report. The detective noted numerous minor lacerations to the
victim s throat, which corroborated what the victim had said, the detective re-
ported.
The victim said that Bernstein was trying to pull him out of the truck by
pulling on his clothing, with the knife in his right hand.

He said that Bernstein had begun striking him in the face with his free
left hand, all the while holding the knife to the his throat with his right hand. During this
altercation, the victim advised, he d attempted to push the defendant away with his left foot,
and at that point, Bernstein was able to grab the victim s ankle and slice the back of his
lower, left calf with the knife. The victim stated that he also sustained two stab wounds to
his left arm, and several cuts to his neck and right hand.
The deputy noted the wounds pointed out by the victim. The report stated that
“many of the minor lacerations observed were indicative of defensive type wounds.” The
victim also had swelling on his forehead and the area under his right eye, which was already
blackening, along with a small laceration that was bleeding under his eye, “obviously caused
by a punch to the face,” the report stated.
