officer asked Swilley what had happened during the altercation at the business. According to
the report, Swilley asked the officer if he wanted the knife that he'd used on the victim. The
officer handcuffed and searched Swilley and found a knife with a three-inch blade in his right
pocket. The report stated that what appeared to be a slight amount of dried blood was on the
knife handle. Other officers arrived on the scene to speak with the victim, a 41-year-old
Homosassa resident who is employed by a Homosassa eatery. He had two "large lacerations"
to his stomach and left arm and was air-lifted to Tampa General Hospital.
The victim told deputies that Swilley had approached him at the rear of the business,
and he'd told Swilley, several times, to leave. However, Swilley did not leave, so he attempted
to escort him out of the business, but Swilley had pulled a knife and cut him with it. According
to the arrest report, Swilley asked the arresting deputy if the victim was okay, and the deputy
replied that he did not know. Swilley said that he had not wanted to kill the victim, he'd just
wanted to stop him from shoving him, that he'd been in the army and knows how to kill
someone. He said the victim kept "messing" with him, so he'd taken the law into his own
hands. He said the victim had been "messing" with him for about three years. The deputy
quoted Swilley as saying," I cut him; I didn't stab him. If I stabbed him, he wouldn't be alive."
Swilley was charged with aggravated batrtery using a deadly weapon. He was held without
bond, due to the fact that he is homeless, the report stated.
